Terms, limits and publication conditions.
The Observer is built for scrutiny. These terms explain the limits of the material, the status of election information and the conditions that apply when using or republishing the site.
About these terms
By accessing this site, you agree to use it lawfully and in accordance with these terms. If you do not agree, you should stop using the site. These terms may be updated by publishing a revised version here.
Editorial status
Next West Observer is an independent civic editorial project. It is not affiliated with, authorised by or acting for the Victorian Electoral Commission, any government body, political party, candidate or campaign.
Reporting may include documented facts, attributed claims, analysis, opinion, scenarios and unresolved questions. We aim to label those categories clearly and provide source notes where practical.
Public-interest criticism
Australian law protects important space for robust discussion, reporting and criticism of government, politics and the performance of public functions. Those protections are significant, but they are not a blanket immunity for every statement or publication.
- The Australian Constitution contains an implied freedom of communication about government and political matters. The High Court has explained that this is a restriction on legislative power, not a personal right to say anything without legal consequence.
- Section 15 of Victoria's Charter of Human Rights and Responsibilities Act 2006 protects holding opinions and seeking, receiving and communicating information and ideas. The Charter principally applies to Victorian public authorities, and expression may be subject to reasonable and justified limits.
- Victoria's Defamation Act 2005 provides defences that may apply when their legal elements are proved, including substantial truth, publication concerning an issue of public interest, qualified privilege and honest opinion based on proper material. Calling something “opinion” or “public interest” does not establish a defence by itself.
These protections operate alongside laws concerning defamation, contempt and suppression orders, confidential or secret information, privacy, copyright, discrimination and vilification, threats and harassment, electoral material and employment duties. Criticism is not unlawful merely because it is forceful or unwelcome, but its wording, evidence, context and method of publication matter.
Sources and protected disclosures
Section 126K of Victoria's Evidence Act 2008 provides a form of journalist-source privilege where a journalist has promised not to disclose an informant's identity. A court may displace that protection after balancing the competing public interests, so it is not absolute.
Victoria's Public Interest Disclosures Act 2012 can protect eligible disclosures about improper conduct or detrimental action in the public sector when the statutory process applies. Sending information to a publisher, posting it publicly or describing it as whistleblowing does not automatically attract that protection.
A person considering disclosure of confidential, restricted or high-risk information should seek independent legal advice and, where appropriate, use an authorised disclosure channel such as IBAC. Ordinary email to the Observer is not a substitute for a protected statutory process.
Election information
Candidate fields, margins, dates, boundaries and other election information can change. Publicly announced candidates are not necessarily official nominees. Always check the Victorian Electoral Commission for official enrolment, nomination, voting and result information.
The Observer encourages voter due diligence and does not campaign for or against a candidate. Editorial criticism, scrutiny or inclusion does not imply endorsement or opposition.

Material on this site is general public-interest information and commentary. It is not legal, financial, investment, medical or other professional advice. Obtain advice suited to your circumstances before acting on information that carries personal, legal or financial consequences.

We take reasonable care with publication, but do not promise that every item is complete, current or error-free. Public records may be corrected, replaced or interpreted differently as further evidence becomes available.

Do not reproduce substantial material, remove attribution, imply endorsement or commercially republish Observer work without written permission. Third-party records, logos and quoted material remain the property of their respective owners.

Links are provided for verification, context or convenience. Next West Observer does not control third-party sites and is not responsible for their availability, security, accuracy or privacy practices. A link is not an endorsement.
The existence of a public record, disclosure, payment, association, allegation or regulatory filing is not by itself proof of illegality, wrongdoing, influence or bad faith.
Messages and submissions
You must not knowingly send unlawful material, malicious code, threats or content that infringes another person's rights. Sending material does not guarantee publication, confidentiality or a response.
Do not send sensitive source material through ordinary email if doing so could create risk. See the Privacy Policy and contact the editorial desk first to discuss safer transfer options.
Shop and consumer rights

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable legislation.
Availability and liability
We may change, suspend or remove content and site features without notice. To the maximum extent permitted by law, Next West Observer is not liable for loss arising from reliance on site material, interruption, third-party content or use outside the purpose for which the material was published.
Nothing in these terms limits liability or rights that cannot be limited under applicable law.
Governing law and contact
These terms are governed by the laws of Victoria, Australia. Courts with jurisdiction in Victoria may hear disputes relating to the site, subject to any rights that apply under other laws.
